For more than three decades we have represented thousands of Americans who have suffered from asbestos diseases such as asbestosis, asbestos lung cancer and mesothelioma. Through this work we have amassed one of the most exhaustive collections of documents and data available about the companies that made and distributed asbestos products, as well as what products contained asbestos.
Throughout our history we have also fought to protect the rights of everyone harmed by exposure to asbestos – not just our clients, but patients represented by other firms and people yet to be diagnosed. We achieved this by fighting for the right to file individual lawsuits for mesothelioma rather than be forced into a class action settlement. In fact, Baron and Budd led the fight for patients’ rights in two landmark U.S Supreme Court victories, Amchem Products v. Windsor and Ortiz v. Fibreboard Corp., which are widely considered to be two of the most significany appellate decisions of the past twenty years for consumers’ rights. Our firm was not specifically compensated for its participation in these cases, but instead took the work because we knew that it was the right thing to do.
Baron and Budd adamantly fought the class action settlement. In fact, the firm was instrumental in pushing for the Fibreboard mandatory class action settlement to be thrown out. This settlement would have severely limited the rights of patients and families affected by asbestos exposure to pursue individual lawsuits based on the specific circumstances of their exposure and the severity of their specific illness.
Achieving this success was not an easy task. In these cases, we fought against powerful asbestos interest groups and, surprisingly, against some other plaintiffs’ law firms who were willing to trade future asbestos victims’ rights for a quick pay day. Because of our work in these cases, an asbestos patients’ right to pursue an individual lawsuit is being honored today.
