Mesothelioma litigation can have many results. We are here to help you get the right one.
Unless the asbestos companies that exposed you have all filed for bankruptcy, there are two possible outcomes for a mesothelioma lawsuit. If you file a claim against an asbestos company or companies, your attorney can either reach a settlement with the asbestos company(s) or take the case to trial, in which a jury will decide on a verdict for your case. So what is the difference between a settlement and a verdict and what does that mean for you?
What is a settlement?
Most mesothelioma lawsuits handled by Baron & Budd settle before going to trial, because the asbestos companies know we have the resources and experience to win a case before a jury, and they don’t want the burden of a trial or the bad publicity it could create for them.
However, you do not ever have to accept a settlement. It is our job to help you make a decision whether to accept a settlement or go to trial.
Often settlements are private.
What is a verdict?
If a settlement cannot be reached, Baron & Budd is fully capable of taking your case to trial, in which case a jury will deliver a verdict. The jury will decide if the asbestos company or companies are liable for your asbestos exposure and subsequent mesothelioma. If the jury decides that the company or companies are responsible, they will determine a monetary amount, which generally consists of compensatory and punitive damages. That is, actual economic loss and an amount of money awarded to punish the defendant or to set a public example.
In 2012, our mesothelioma lawyers achieved a $48 million verdict for a California client against Union Carbide, a subsidiary of Dow Chemical, and others, which was the largest mesothelioma verdict in California in 2012.
A combination of outcomes
When a mesothelioma lawsuit is filed, it is common to pursue multiple asbestos companies for compensation. Many mesothelioma victims have been exposed to several products containing asbestos. Therefore, a person filing a mesothelioma lawsuit can receive compensation from a combination of the above outcomes from several different defendants.
Over our 35-year history, we have negotiated numerous settlements for our clients and tried numerous cases to verdict. We have won over 100 individual verdicts for our asbestos victims and have achieved precedent-setting results.
