Arnold v. Dow Chemical Co., 32 F.Supp. 2d 584 (E.D.N.Y. 1999)
Our client’s husband died of multiple myeloma because of his exposure to high levels of trichloroethylene (”TCE”) while working at a New York aerospace plant. The U.S. District Court for the Northern District of New York ruled that the plaintiff’s expert testimony describing TCE exposure as the cause of his disease was admissible at trial under the Daubert factors set forth by the United States Supreme Court to determine the scientific reliability of the methodology used by an expert witness.
