Massachusetts woman and son sued for illegal asbestos dumping

A mother and son are being sued for allegedly failing to clean up an illegal dumpsite used to dispose of asbestos waste. On July 14, Attorney General Martha Coakley filed a lawsuit against Helen M. McCarthy and her son James F. McCarthy in Suffolk Superior Court. The lawsuit alleges that the pair dumped solid waste for at least a decade in protected wetlands bordering on the Saugus River. The wetlands are adjacent to property owned by the McCarthys.

The object of the lawsuit is to force the McCarthys to clean and restore the wetlands. This is not the first time the McCarthys have been hauled into court for illegal toxic waste dumping. The Massachusetts State Department of Environmental Protection handed Helen McCarthy a $220,000 fine for numerous violations in 2007. That fine also came with an order to clean up the area and properly dispose of the hazardous materials.
