Connecticut businessman fined for excavating contaminated soil

Joseph S. Marcell of Stratford, Connecticut will be paying over $11,000 in civil penalties and cleanup costs related to excavation of heavily contaminated soil. Marcell’s mother owns Stratford Self Storage, an undeveloped commercial property that is heavily contaminated with asbestos, lead and PCBs. The state Department of Environmental Protection (DEP) and federal Environmental Protection Agency (EPA) banned any excavation of the area, but Marcell defied the ban by digging in May 2009.

Attorney General Richard Blumenthal and the DEP obtained a court order to halt the excavation. Cleanup of the site took three days. Per his settlement, Marcell has been ordered to pay $8,705 for the cost of the cleanup plus a $2,500 civil penalty.
