Settlement proposed to give refunds for CSI toys contaminated with asbestos
A proposed settlement was announced by Public Justice and the Asbestos Disease Awareness Organization (ADAO) for the class action lawsuit filed against CBS Broadcasting, Inc. and major toy retailers. The settlement calls for a nationwide recall and cash refunds to be given to consumers who purchased toy CSI science kits that may contain asbestos. The product manufacturer, Planet Toys, is not part of the settlement because it filed for Chapter 7 bankruptcy protection in March 2009.
In 2007, ADAO tested and found tremolite, a deadly form of asbestos, in the white fingerprint powder that came with the CSI: Crime Scene Investigation Fingerprint Examination Kit (CSI Exam Kit) and the CSI: Crime Scene Investigation Forensic Lab Kit (CSI Lab Kit). These findings were confirmed by three independent, government-certified laboratories.
The prospective settlement, which is awaiting court approval, will grant cash refunds to U.S. consumers who purchased or received the CSI Exam Kits or CSI Lab Kits as gifts. Consumers who want to seek refunds will have to submit a claim form to the claims administrator by January 14, 2010. They will also have the option to send the toy kits to the claims administrator at no cost.
