Last-minute provision to Wisconsin budget could affect some asbestos lawsuits

A provision quietly added to Wisconsin’s state budget could affect some asbestos lawsuits by mesothelioma victims and others with asbestos-related diseases. The provision, which was added without the benefit of a public hearing, would limit lawsuits against companies that, prior to 1972, merged with smaller companies that made asbestos products.

Proponents of the provision say it is narrowly written to limit the liability of Crown, Cork & Seal, a Philadelphia-based company with plants in Wisconsin. The company had bought Mundet Cork Co., which made asbestos-containing products, in 1963. The companies eventually merged.

Critics of the provision say it could adversely affect mesothelioma victims and others seeking redress from companies other than Crown, Cork & Seal.
