UK insurance companies fight Scottish law allowing compensation for asbestos pleural plaques

Insurance companies in the UK are fighting to overturn a Scottish law providing compensation to workers who develop pleural plaques caused by occupational exposure to asbestos. Workers with pleural plaques face an increased risk of developing mesothelioma and asbestos-related lung cancer. Hundreds of Scots, including former shipyard workers, have developed mesothelioma and lung cancer due to exposure to asbestos on the job.

The insurers argue that because there are no symptoms associated with pleural plaques, they should not be responsible for compensating workers who have the disease. The Damages Act was passed in March 2009 with cross-party support. British insurers are seeking judicial review of the legislation by the Court of Session in Edinburgh.
