Tennessee Supreme Court holds that employer has duty to prevent foreseeable take-home asbestos exposure to workers’ families

The Tennessee Supreme Court recently held that, when an employer knows or should know that workers can endanger their families to danger by going home in contaminated clothing, the company must prevent employees from wearing home their contaminated clothing. In that case, the father’s employer knew dangerous levels of asbestos from its factory could contaminate workers’ clothes and be carried home to expose family members. When the plaintiff was an infant, born premature, her father held her in arms each evening while still wearing his asbestos-covered work clothes. Because of this exposure, she developed the cancer mesothelioma and died at the age of 25. Because the court found the employer had a duty to protect employees and their families from foreseeable, the case was returned to the trial court to go to trial.
