Northshore Mining is appealing air quality standards that require it to limit asbestos emissions in and around Silver Bay, Minnesota
Northshore Mining Company currently has an operating permit that limits its asbestos emissions. Based on an old court decision, the current permit says that the level of asbestos fibers in the air around Northshore’s Silver Bay plant must be no higher than the level of asbestos fibers in the air in St. Paul. Northshore tried to get a federal judge to revisit this old court opinion, but the judge refused to do so because the standard from the court opinion had already been incorporated into the state permit. See related story. So now Northshore is appealing its permit restrictions in state court, trying to get rid of the current limits on asbestos emissions. Opposing them in the appeal will be the Minnesota Center for Environmental Advocacy.
