Trinity Industries seeks access to its former Greenville, Pennsylvania railcar plant to look for asbestos and other hazardous materials

After being charged with illegally dumping hazardous materials on its former railcar site, Trinity Industries reached a plea agreement which required it to clean up the site. Trinity has sued the new owner of the site for contributing to the contamination by demolishing buildings and releasing asbestos and other hazardous materials. The new owner has refused permission for Trinity and its environmental consultant to enter and inspect the site, and Trinity has asked a judge to order that its environmental consultant be allowed on the property. The lawsuit also claims that the new owner bought the property as is. The new owner says it agrees to be responsible for any cleanup of the property’s surface, but it denies responsibility for any underground contaminants. The new owner also says that Trinity has shown no compelling need to enter the property, allowing Trinity access would interfere with the new owner’s efforts to revitalize and market the property, and if Trinity needs access to the property, it should seek it from the Pennsylvania Department of Environmental Protection as part of the plea agreement.
