A retired West Virginia circuit judge, who is a leading expert on the system by which West Virginia’s courts handle asbestos claims, told legislators that any changes to the system would be unwise and are unnecessary. Judge Andrew MacQueen himself handled thousands of asbestos claims during his 22 years on the bench, claims for diseases like asbestosis and malignant mesothelioma. Judge MacQueen noted that, although it is a small state, a great deal of asbestos was used in West Virginia, leading to a large volume of claims against asbestos manufacturers. Judge MacQueen assisted the West Virginia’s Supreme Court is establishing a Case Management Plan to handle these claims efficiently, but Judge MacQueen says the proposed legislation would destroy that system. Judge MacQueen says the current Case Management Plan is popular with and fair to all parties.
