On August 23rd, Judge Walter Rice ruled that there will be a jury trial on area residents’ claims concerning nonradioactive hazardous releases, including releases of asbestos, from the Portsmouth Gaseous Diffusion Plant, a former Department of Energy Nuclear facility located in Piketon, Ohio. No trial date has been set. Health investigators have found that the Piketon plant released asbestos, chromium, fluorides, trichloroethylene (TCE), nitric acid, chlorine, uranium and technetium into the community. The case is similar to one brought by residents who lived near the Feed Materials Production Center at Fernald, Ohio, which was settled for $78 million.
