The U.S. Court of Appeals for the 9th Circuit has overturned rulings by a Montana federal judge in the criminal asbestos case against W.R. Grace. The three-judge appeals panel found that the trial judge exceeded his authority by disallowing nine government witnesses and three environmental health studies at trial. The case against Grace, called by federal officials as one of the most significant environmental crimes in decades, charges the company and seven current and formal company executives with conspiracy and obstruction for knowingly spreading asbestos for decades in the mining town of Libby, Montana.
